These Terms of Service ("Terms") form a binding agreement between you and Joshua Wilder, a sole proprietor doing business as TORQUE_OS ("TORQUE_OS", "we", "our", or "us"), governing your access to and use of the TORQUE_OS website, applications, and services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Not affiliated with ASE
TORQUE_OS is an independent study platform. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to the National Institute for Automotive Service Excellence (ASE®). "ASE" is a registered trademark of its owner and is used here only for nominative descriptive purposes to identify the certification exams our content helps technicians prepare for.
3. Your account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and keep it current. Notify us immediately at support@torqueos.app if you suspect unauthorized access.
4. Payments, subscriptions, and refunds (Merchant of Record)
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.
Paid plans renew automatically at the then-current price until cancelled. You may cancel at any time from your account settings; cancellation stops future renewals and paid access continues through the end of the current billing period. Refund eligibility is described in our Refund Policy.
5. Study content and no guarantee of exam results
Our content is provided for educational purposes only. Passing an ASE certification exam depends on factors outside our control, including your effort, experience, and the specific version of the exam you sit. We do not guarantee that use of the Service will result in a passing score.
6. AI tutor — acceptable use and accuracy
The Service includes an AI tutor that produces automated responses. You agree not to use the AI tutor to generate content that is illegal, harassing, defamatory, hateful, sexually explicit involving minors, that infringes intellectual property, that facilitates malware or security intrusion, or that attempts to jailbreak or circumvent safety controls. You are responsible for your prompts, for how you use outputs, for verifying accuracy, and for having the necessary rights to any content you submit.
AI responses may be incomplete, outdated, or incorrect. Do not rely on AI output for real-world vehicle service, safety-critical repair decisions, or diagnostic actions. Always consult the vehicle manufacturer's service information and follow proper safety procedures. We reserve the right to moderate, filter, or refuse outputs, remove content, and suspend accounts that violate this section.
7. Acceptable use
You must not misuse the Service. Prohibited conduct includes unlawful use, fraud, spam, infringing intellectual property, interfering with security (malware, probing, scraping, rate-limit circumvention), and any conduct described in our Acceptable Use Policy, which is incorporated into these Terms.
8. Our intellectual property
All content we produce — flashcards, quiz questions, explanations, articles, code, brand elements, and UI — is owned by TORQUE_OS or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial study. You may not copy, redistribute, scrape, reverse-engineer, or resell our content.
9. Your content
You retain ownership of anything you submit (e.g., tutor prompts, feedback). You grant us a worldwide, royalty-free license to host and process it solely to operate and improve the Service.
10. Service level and disclaimers
We do not guarantee that the Service will be uninterrupted, error-free, or continuously available. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORQUE_OS AND ITS OWNER, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR USD $100, WHICHEVER IS GREATER. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW, INCLUDING FOR FRAUD, DEATH, OR PERSONAL INJURY.
12. Indemnification
You agree to indemnify and hold TORQUE_OS harmless from any claim arising out of your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
13. Suspension and termination
You may delete your account at any time from the Profile page. We may suspend or terminate your account for: material breach of these Terms or the Acceptable Use Policy, non-payment, credible security or fraud risk, or repeated or serious policy violations. On termination, your license to the Service ends and we may delete your data after a reasonable export window.
14. Changes
We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use after the effective date constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the United States and the state in which the owner of TORQUE_OS resides, without regard to conflict-of-laws principles.
